The sad truth today is that educators are increasingly the target of work-related lawsuits brought by disgruntled students, parents and even coworkers.

Examples of professional liability lawsuits

Educators are facing legal challenges for an expanding array of actions they take or fail to take in the classroom and other work-related venues.

Here are some recent examples of professional liability lawsuits and claims:

The parents of a high school student sued his teacher, principal and superintendent, alleging damage to their son’s academic reputation and college prospects because the teacher would not allow him to make up a missed assignment and gave him a grade of C+ in the course.
On a field trip, a student disobeyed instructions, left the group, fell and was injured. His parents sued the teachers who led the trip, alleging improper supervision.
A member of a religious club was injured on school property and sued. The school board refused to defend the principal named in the suit, alleging the principal acted recklessly in allowing the school to be used by the religious club.
A teacher was sued for failure to supervise after a student was injured using a table saw in shop class.
A history teacher was sued by a student for allegedly making disparaging remarks about Christianity in his class and fostering a hostile environment toward Christians.
A university administrator was sued for challenging a professor’s tenure recommendation.
A school refused to defend its principal who was accused of failing to take action to stop harassment of a student. The school claimed its liability policy excluded emotional distress and harassment of a student by other students.
A teacher who accused an aide of insubordination was sued by the aide for false accusations that led to termination of the aide.
A college student sued her professor and the director of her degree program, alleging that they conspired to prevent her from attaining a master’s degree by giving her a lower grade.
A university professor was sued for putting a student on academic probation that resulted in the student's dismissal.
A superintendent authorized repairs to a school. Years later, when the repairs were alleged to have been faulty, resulting in a lawsuit, a new school board refused to defend the superintendent on grounds that he did not have authority to authorize the repairs.
A high school teacher kicked a student out of class for making a comment against homosexuality during the school’s anti-bullying day. The student sued the teacher for allegedly violating his right of free speech.
