“If a client ever threatens to sue you, you need to take that threat seriously. This is because it will allow you to prepare for whatever may follow. Even if you don't think your client's claim has any merit, informing your professional liability insurer is an important first step to protect yourself.”

What information should I provide to my insurer?

“The more information you can provide about the potential claim, the better your insurer and its attorneys will be able to defend you against it. When you make your first call to your insurer, be prepared to give at least your name, business name, contact information, policy number, and a brief description of facts surrounding the claim.”

What will my insurer advise me on?

“Contacting your insurer about a potential lawsuit gives them the opportunity to advise you every step of the way. The insurer can appoint an attorney to work with you on deciding how best to respond to your client's claim, or you may be advised simply to wait and see what the client does while continuing to keep records of your interactions.”
